Bias as an Express General Aggravating Factor

The Criminal Code of Andorra contains general provisions that expressly enable the racist or other bias motives of the offender to be taken into account by the courts as an aggravating circumstance when sentencing.

Article 30.6 of Criminal Code, adopted 23 September 2005, considers crimes to be aggravated when committed because of racist and xenophobic motives, or reasons related to ideology, religion, nationality, ethnic origin, sexual orientation, disease or physical or mental disability of the victim.
