Lousiana v. CDC

To support the Biden administration’s appeal of the district court’s permanent injunction preventing the termination of Title 42, Human Rights First joined the Tulane Immigrant Rights Clinic and forty other legal service and advocacy organizations in filing an amicus brief in Louisiana v. Centers for Disease Control in the Fifth Circuit.

The use of Title 42 of the Public Health Services Law to circumvent domestic and international obligations that allow migrants to seek asylum in the United States was a Trump-era measure.  The measure has been roundly criticized by public health officials as wholly ineffective as a public health measure and having no basis or justification in science and has been discriminatorily applied to migrant populations based upon their country of origin.

We have consistently pressed both the Trump and Biden administrations to end this disastrous policy, which turns migrants away at the border without allowing them the right to make asylum claims, forcing many to wait on the southern side of the U.S.-Mexico border, where they face dangerous and appalling conditions and have been subjected to murder, kidnapping, rape, torture and other violent attacks.
